Do You Need a Party Wall Surveyor?

Under The Party Wall Act 1996, you must formally notify any adjoining owners if you plan to excavate for a new building within:
- 3 metres of any part of a neighbouring building where any part of the work would go deeper than the neighbour’s foundations, or
- 6 metres of any part of a neighbouring owner’s building where any part of the work will meet a line drawn downwards at 45 degrees in the direction of the excavation from the bottom of the neighbour’s foundation.

How Long Does the Party Wall Process Take?
Steps
The following steps are a simplified overview to assist you in understanding the timings of each stage.
Before any work can begin, there are statutory notice periods for the notices to run.
- Once a notice has been served, the neighbour has 14 days to respond. Depending on the type of notice, it will either be a one or two-month notice.
- If the neighbour dissents from the Party Wall notice, surveyor(s) are appointed for both the building owner and neighbour.
- The surveyors meet on site and a schedule of conditions on the neighbour's property is prepared. (typically another 14 days)
- Your surveyor will also prepare a draft Award for comment and approval by your neighbour’s surveyor.
- This draft will likely have amendments from the neighbour's surveyor. (typically 14 days)
- The final version of the Party Wall Award is completed, signed and served upon both parties.
These are the basic timings, however it is suggested that you allow many months before starting construction to initiate the PARTY WALL procedure.
